These terms govern your use of M-Plus (“the Platform”), which lets people vying for elective office in Kenya receive campaign donations over M-Pesa. By registering a campaign, or by making a donation, you accept these terms.

1. What M-Plus does — and does not do

M-Plus is a payment and publishing tool. It collects donations on behalf of an aspirant, records them, and pays the aspirant’s share to their M-Pesa number.

M-Plus does not endorse, vet the politics of, or campaign for any aspirant. Publishing a campaign is not a statement about the aspirant’s suitability for office, and it is not a guarantee about how they will use money they receive. An administrator may suspend a campaign that breaks these terms.

2. The service charge

Every donation is split the moment M-Pesa confirms it. The aspirant is credited 80% and M-Plus retains 20% as a service charge, unless a different rate is displayed on the donation page at the time of payment. The rate charged is recorded against each donation and does not change afterwards, even if the platform rate later changes.

3. If you are an aspirant

• You must give accurate details and submit your genuine national ID and a photograph of yourself. Registering under another person’s identity is fraud.
• One national ID may back one campaign.
• The M-Pesa number you give is where your money is sent. Keeping it correct is your responsibility.
• You are solely responsible for complying with Kenyan law on campaign financing, including the Election Campaign Financing Act and any IEBC requirements on contribution limits, sources and reporting. M-Plus does not file anything on your behalf.
• You are responsible for any tax arising on funds you receive.
• Your campaign may be suspended or rejected if your documents cannot be verified, if the campaign appears fraudulent, or if it is used unlawfully. You will be told the reason. Money already credited to you remains yours.

4. If you are a donor

• Donations are voluntary gifts. They are not purchases, investments, or loans, and they carry no expectation of any benefit, favour or return.
• Donations are not refundable once M-Pesa has confirmed them. If you believe a payment was taken in error, contact us and we will investigate; where an error is established and the funds have not been withdrawn, we will try to correct it.
• You must be entitled to give the money you are donating, and donating on behalf of an undisclosed third party may be unlawful under campaign financing law.
• Never share your M-Pesa PIN. M-Plus will never ask for it, and no message from us will ever request it.

5. Withdrawals

An aspirant may withdraw their available balance to their own M-Pesa number, subject to the minimum shown in the portal. Funds are held until withdrawn. Payouts depend on Safaricom’s systems; if a payout fails, the amount returns to the available balance.

6. Availability and liability

The Platform depends on Safaricom’s M-Pesa APIs and on network availability, and is provided on an “as is” basis. We do not guarantee uninterrupted service. To the extent permitted by law, M-Plus is not liable for indirect or consequential loss, or for loss arising from a failure of a third-party payment or messaging provider. Nothing here excludes liability that cannot lawfully be excluded.

7. Changes and governing law

We may amend these terms; the version shown here at the time of your transaction is the one that applies to it. These terms are governed by the laws of Kenya and are subject to the jurisdiction of the Kenyan courts.
